Terms and Conditions

IMPORTANT ADDITIONAL INFORMATION REGARDING YOUR BOOKING: You must not accept any booking unless you understand and agree with the following Terms and Conditions.

These Terms and Conditions (“Terms”) govern the relationship between Life List Travel, LLC (“Agency”, “Life List Travel”, “we/us/our”) and you (including all Travelers on the same booking who share the same household) (“client”, “passenger”, “you/your/yourself”).

www.lifelisttravel.com (or any of its affiliated entities) is referred to as Life List Travel, LLC.

Travel Agent: Life List Travel, LLC and its affiliated entities act as a travel agent only. We sell various travel related products on behalf of numerous transport and accommodation service providers, including, but not limited to airlines, coach, rail, cruise line operators, tour operators and hotels named in your itinerary (Suppliers). Life List Travel, LLC does not own, operate, manage or control these independent Suppliers of services and is not liable for their acts or omissions. Life List Travel, LLC’s obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. A request cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific provider and not against Life List Travel, LLC.

Life List Travel assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; (3) any wrongful or negligent acts or omissions on the part of any other party not under Life List Travel, LLC’s control; and (4) any Supplier price drop after your travel arrangements have been confirmed, paid in full, or ticketed. You hereby release Life List Travel, LLC from all claims arising out of any problem covered in this paragraph.

Important Conditions: Prices are subject to change prior to purchase. Prices are subject to supplemental price increases that may be imposed by the Supplier and/or government after you have paid your deposit but prior to when you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees.

Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms. Quotes in foreign currency are subject to fluctuations in exchange rates and international credit card issuer or transaction fees.

As noted above, by making the booking, you expressly acknowledge your acceptance of these conditions (i.e. increases before full payment and increases attributable to government-imposed taxes, fees or carrier imposed surcharges after full payment will be your responsibility) applicable to your purchase.

Cancellation: Please be aware that most travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Hotels may not permit changes to or cancellation of reservations, subject to the terms and conditions of the hotel reservation. Where Life List Travel, LLC incurs any liability for a cancellation fee or charge for any booking which you cancel, you agree to indemnify Life List Travel, LLC for the amount of that fee or charge.  All cancellation requests must be sent to Life List Travel, LLC in writing.

You waive any right to a chargeback in case of cancellation (except for fraud), including any force majeure event (as described below). If you attempt a chargeback, reverse charge, or recollection of a payment already made without Agency’s authorization, Agency reserves the right to charge you additional costs, fees, and expenses associated with such chargeback, reverse charge, or recollection, including without limitation attorney’s fees and legal costs.

Any cancellations made to a reservation are subject to a fee of $100.00 per person to cover administrative costs, payable to Life List Travel, LLC. This fee is in addition to any other Supplier charges and penalties. No refunds will be given for any cancelled, unused, or partially used travel service(s).

Force Majeure: Life List Travel, LLC will not be in breach of these terms and conditions or otherwise be liable to you, for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of Life List Travel, LLC. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.

In addition, each of Life List Travel, LLC’s Suppliers have terms and conditions which include Force Majeure provisions. In the event that a Force Majeure event occurs, those Suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier, pursuant to their policies, although Life List Travel, LLC shall use its reasonable efforts to secure reimbursement for you where possible.

Credit Card Transactions: If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the travel service provider, and not against Life List Travel, LLC, and in the event that payment has been made to Life List Travel, LLC by credit card, you agree that you will not seek to charge back your payment to Life List Travel, LLC. If Life List Travel, LLC incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owing to Life List Travel, LLC via money order or cash immediately.

Travel Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. However, no representation or description of the insurance made by Life List Travel, LLC to you, constitutes a binding assurance or promise about the insurance. Life List Travel, LLC is not an insurance company and has no responsibility for the submission, payment, or adjustment of any insurance claims. Any claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy.

Additional Fees: Additional taxes and surcharges (including carrier-imposed surcharges) that cannot be pre-collected may be charged locally by car rental agencies, hotels, or other Suppliers.

Baggage Fees: Additional fees for baggage may apply. Please contact your airline or refer to its website for detailed information regarding their checked baggage policies.

Responsibility: We always do our best to make sure your travel arrangements are satisfactory. However, Life List Travel, LLC and its affiliates and their employees, shareholders, subsidiaries, officers, directors, successors, agents and assigns do not own or operate any entity which provides goods and services for your travel including without limitation, lodging facilities, airline, vessel, motor coach, or other transportation companies, guides or guide services, local ground operators, providers or organizers of optional excursions, food service providers, etc. All such persons and entities are independent contractors and are in no way affiliated to Life List Travel, LLC or any of Life List Travel, LLC’s affiliated entities.

Liability: Life List Travel, LLC is not liable for any negligent or willful act or failure to act of any travel service provider or of any third party. In addition and without limitation, Life List Travel, LLC is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time. Also, be advised that certain foreign facilities such as air-conditioning systems in public places, hotels and motor coaches may not be up to U.S. standards. If due to weather, flight schedules or other uncontrollable factors you are required to spend additional night(s), you will be responsible for your own hotel, transfers, and meal costs. Baggage is entirely at owner’s risk. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. You specifically agree that Life List Travel, LLC is not liable for any consequential loss or damage.

Passports: All individuals departing from the United States of America must be in possession of a valid passport. It is your responsibility to ensure that you have valid travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination. You are responsible for confirming with the United States Department of State or representative government agency of the country to which you are traveling the requirements for visas and/or other requirements for admission to your destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. A government issued photo ID approved by the TSA is required for air travel within the USA. If a passport is required to travel, most countries require that the expiration date be at least six (6) months following the return date of the planned travel.

Travel Documents: Travel documents include, without limitation, airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions such as, but not limited to, being nonrefundable, non-date-changeable, and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. Any errors in names, dates and timings may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings on your documentation will be your responsibility if not advised at the time of booking.

Health and Special Requirements: It is your responsibility to ensure you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation. Please advise your advisor of any special requirements you may have, for example, special meals, medical requirements, and so on.

No Special Knowledge of Conditions: Life List Travel, LLC has no special knowledge regarding the financial condition of the unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, Life List Travel, LLC recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, Life List Travel, LLC recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release Life List Travel, LLC from all claims arising out of any problem covered in this paragraph.

International Flights: Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. Please see the Department of Transport Disinsection Website for more information.

Refusal of Service: Service providers reserve the right to refuse service to travelers at their sole discretion and including without limitation if the traveler:
• Lacks proper documentation for the country of destination;
• Has a contagious disease;
• Is under the influence of alcohol, drugs or narcotics; and/or
• Manifests disruptive and/or unruly behavior.

Life List Travel, LLC assumes no liability for the acts of the service provider in refusing service.

Reservation of Rights: We reserve the right, in our sole discretion, to change these Terms and Conditions at any time without prior written notice.  The effective version of these Terms and Conditions is located at www.lifelisttravel.com

General: The laws of the State of Tennessee govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Hamilton County, Tennessee in all disputes arising out of or relating to travel bookings with Life List Travel, LLC.

If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.

These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Client and Life List Travel, LLC with respect to travel bookings made with Life List Travel, LLC by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and Life List Travel, LLC with respect to communications with Life List Travel, LLC. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
